In some countries, particularly in Germany, the legal relationship between the employer and the employee acting as inventor with regard to so-called service inventions is not (only) regulated by contract, but even by law, for example in the German law on employee inventions (also known as the “Arbeitnehmererfindungsgesetz” or “ArbnErfG” for short).

The law defines a number of mutual rights and obligations. On the employer side in particular, a number of regulations must be observed and the not always popular topic of “inventor remuneration” must also be dealt with. On the employee side, on the other hand, there is usually an interest in being appropriately remunerated in accordance with the ArbnErfG.
